Standard Terms & Conditions
The standard terms and conditions (‘Terms’) below form an agreement between the Customer (as named in the Booking Form) and Nostaloft Sdn Bhd (‘Nostaloft’):-
- Any order/booking for good(s) (‘Goods’) in the Booking Form shall be deemed to be an offer made by the Customer to Nostaloft for the purchase of Goods in accordance with this Terms. The Customer shall be responsible for the accuracy of the details for the order/booking.
- The price payable for the Goods ordered/booked (‘Purchase Price’) shall be as set out in the Booking Form and duly acknowledged and agreed by the Customer.
- Upon confirmation of the order/booking, a NON-REFUNDABLE deposit of 50% of the Purchase Price (‘Deposit’) shall be payable to Nostaloft as a guarantee of performance (‘Confirmation’). Upon Confirmation, the order/booking shall not be cancelled unless otherwise agreed by Nostaloft.
- If the order/booking is cancelled, the Deposit can be used for changing and/or swapping of Goods only. Nostaloft practises a strictly no cash refund policy.
- All Goods ordered/booked are designed, manufactured and/or built upon Confirmation. The Customer agrees that Nostaloft requires for a period of at least 90 to 180 working days to complete the order/booking (‘Manufacturing Period’). In the event of any further extension, Nostaloft will notify the buyer accordingly. All Nostaloft’s rights are reserved.
- Any change of colour, feature and/or design of the Goods during the Manufacturing Period is subject to additional charges which shall be advised by Nostaloft upon request by the Customer. However, no change(s) shall be allowed if the Goods have been duly manufactured and/or shipped from the manufacturing country.
- The balance purchase price shall be payable by the Customer upon notification by Nostaloft on the completion and/or arrival of the Goods, failing which, Nostaloft is entitled to forfeit the Deposit and resell and/or dispose the Goods without notifying the Customer.
- Upon receipt of full payment, Nostaloft will arrange the time with the Customer for the delivery of Goods at the Customer’s address for delivery (‘Location’).
- The risks in the Goods shall pass to the Customer upon the delivery.
- A warranty letter will be provided by Nostaloft as product warranty during the delivery of the Goods. In any event, Nostaloft’s warranty does not cover damage(s) caused by non-residential use, improper cleaning method or chemical treatment, direct sunlight exposure and damage(s) resulting from any liquid and chemical materials.
- The Customer must inspect the Goods immediately upon the delivery and inform Nostaloft’s personnel at the Location if there is any defect or damage found on the Goods as a result caused by Nostaloft.
- Nostaloft may then replace the defective Goods upon satisfaction of Nostaloft that the defect or damage was caused by Nostaloft and no others. Nostaloft shall have the discretion to replace either the whole or part of the Goods depending on the severity and condition of the defect or damage.
- As all the Goods are made of natural materials, any natural features found on the Goods, including but not limited to birthmark, wrinkles, scratches, difference in colours (but under same colour code), scars, veins, spots, freckles and the like are NOT considered as defect or damage and/or the same are not returnable, refundable and/or replaceable.
- Any claim of defect or damage by the Customer after delivery will be treated as warranty claim and standard warranty will be followed.
- In the event that exchange and/or replacement is allowed, the cost for returning the Goods shall be borne by the Customer. The Customer further agrees that Nostaloft shall have a turnaround time of 90 working days or a period of time as advised by Nostaloft to proceed with the exchange and/or replacement of Goods.
- In any event, the Goods are not exchangeable and/or replaceable where in Nostaloft’s reasonable opinion that the Goods have become unacceptable due to wear and tear, misuse, damage and/or defective caused by the Customer.
- For clarity, Nostaloft practises a strictly no cash refund policy.
- All Nostaloft’s rights are reserved. Nostaloft retains the discretion to change and/or amend the above Terms from time to time where necessary.
Returns & Refund
Except as otherwise expressly provided herein, we shall not accept the return of a Product which has been delivered unless it is with our prior written consent and agreement. Only a return authorised by us will be accepted and our acceptance of any return of a Product shall be subject to such terms and conditions as we may prescribe at our sole and absolute discretion.
